How is the value of my case determined?
Case value is generally driven by; (1) the strength of the liability theory (Is there clear negligence by the at-fault party?), and (2) the amount of damages suffered by the injured. In South Carolina, the law allows injured plaintiffs to recover monetarily for medical expenses (including rehabilitation and physical therapy), loss of income (past and future), pain, suffering, mental anguish, and loss of enjoyment of life. In wrongful death cases, the deceased’s loved ones are entitled to recover for lost companionship/support as well as for the conscious pain and suffering experienced prior to the passing of the deceased. In certain circumstances where injury or death is the result of egregious or reckless conduct, the law allows for punitive damages to be awarded.
